Smile Attorney is saying that I committed fraud against Discover

My mother passed away in January. I have no money, no credit, no nothing. At one point in time in the past she had me as an authorized user on her Discover card to help me estabilish credit. She kept the card. I never used it. It was in name only. It was never meant to be used by me until her death.

She always told me to use that card to cover her burial expenses and pay it off when the house was sold. When she passed I could not find the card with my name on it. I used her card but signed my name.

Now the atty handling the probate is saying that I committed fraud against Discover. Apparently I am not an authorized user anymore. He says that now he has to go before the judge and convince him that I did not do it intentionally. That if he is not successful, a warrent could be issued and I would go to jail.

I really don't want to go to jail. But in reality will they do that? I am on ss disability for ten years. Never been in trouble and haven't had a speeding ticket in forever. The total of the burial was $8800.00. Are they gonna dig her up and demand the money from her? I also have a concern about my disability. Would I lose it if I am convicted? Considering the amount wouldn't that be considered a felony?

Please help. For someone that has never been in trouble before, this is a big deal. Thank you everybody
