Default Abandoned rail forridors

I live in ND and my fiancé and I have been walking on several old abandoned railroad corridors. Can we take the metal we find, most are buried 1-3 inches deep and sell it for scrap? All of these corridors have been torn up for many years. Very grown over by weed, grass, and trees.

You cannot legaly do so--it belongs to the railroad still.
