Pay Out for Property
I bought a hosue in December 2002 with my father. He put down R160000 in cash and I took out a bond for R540000. My dad gave me an additional amount as cash towrads the house and I used part of it (R50000) to spend on putting a pool in, landscaping the garden, putting security in, etc.My bond repayments were about R5000 per month. In November 2003 I got involved with someone and he moved into the house with me (my dad was also living there at the time). For the next 12 month period I continued to pay my bond and we decided that he could put an equal amount into a "kitty" which was put into a credit card account and we used this money for various household expenses and various other purchases. He did not contribute anything directly to the bond but was in essence paying towards the monthly household expenses, food, etc. In December 2004 we decided to buy my dad's share of the house from him and which would perceived as my partner's share in the property. The property was now valued at about R900000 and so extended my bond by R500000 so that my oartner would not have to pay transfer fees to re-register the bond into his name as well. We paid my dad his share which was R450000 and the used the other R50000 to do renovations amd buy some new furniture.For the next 29 months we both paid an equal amount toward the bond as well as the monthly household expenses. The payments towards the bond equalled about R156000 each for the 29 months. He also put in an additional amount of R35000 toward the hosue in 2006 in the form of extending the patio, new granite counter tops in the kitchen and an air con unit in the bedroom. We split up in May 2007 and as I was going to keep the house I had to pay him out. I had the hosue valued and the value was now R1,45million. The amount owing on the bond in May 2007 was around R970000 (before I took out the additional R200000) In the end I paid him R200000 cash which he was not happy about but he took it anyway. He is now (a year later) saying that it is not enough and he expected more and it should be due now. Have I really been unfair in the amount that I paid him out?
