My girlfriend had a car repo''d in Nov 2003 in NY. She never received notice of resale. She never received ANYTHING. She recently financed another vehicle and an attorney comes out of the woodwork with a garnishment at her job? This is the first she has heard about this since the repo. Can they do this? We now live in AZ

If the car was repo'd they will usually sell it at an auction. The sale price is usually much lower than the amount in which she owed for the car. Plus when the car is repo'd, the customer is billed for the cost of the repo, the storage fees to keep the car before it is sold, any make ready cost, and any acution fees. You girlfriend is responsible to pay all of these cost + what the balance left to pay on the car- the amount the car was sold for. If the car wasnt sold that means she owes all of the $ due. when she applied for a new car loan her credit report was updated with new contact information (you say you are now in AZ) If the creditor didnt know how to contact here or if she was avoiding the creditor, that would be why she doesnt know if the car was ever sold.
