Problems with Car Dealership

Unhappy Problems with Car Dealership

I am not sure if I am posting this in the proper place...but here goes. I've recently purchased a brand new Hyundai Santa Fe through a Hyundai dealership. The problem is, the contract has been signed...yet I still do not physically have this vehicle. The contract was signed on the 12th of this month and they keep promising me different days that the vehicle is arriving..yet it never seems to arrive. The contract was signed because my trade in (my Honda Civic) was apparently already sold through their company and they needed it asap. They promised my vehicle the following week (Monday) but it has been at least 2 weeks of promises (lies). Needless to say, I'm getting pretty fed up with this place and these people. They wouldn't even call the head branch without me telling them to, to find out what happened with the delivery of my vehicle. I still don't know what happened..they just promised me either Wednesday or Thursday of this week. Today is the deadline. After this...I do want to break my contract. I don't know how to go about this though and if I can do it legally. I have not put any money into this vehicle other than my trade in...but obviously if I am able to break this contract I will need my supposedly already sold vehicle back. I hope I have explained my situation clearly enough. I really need some direction...because I feel like this company is yanking my chain and trying to scam me or something. I really need to know what to do and would appreciate any help whatsoever. I reside in New Brunswick Canada so I am unsure if you know of the laws here...but I'll take any advice I can get. Thank you so much!

Act fast if you financed the vehicle! If you did finance remember that the car dealership and the financing company (lender) are two different companies (hopefully). Call the lender ASAP, tell them what happend. The lender may consider this fraud on behalf of the dealership because the lender pays the dealership and if they already accepted the money without delivering a vehicle, they will be in big big trouble. Contact them by phone and by certified mail. You absolutly need to make all of your efforts in writing, certified mail so that it can be tracked. Contact by phone first, for the sake of time but always follow up with mail. Next send a certified letter to the dealership. Then contact the auto maker directly and try to get a regional director/manager's contact information and make a formal complaint. This is not legal advice but I had something similar happen to me and I also used to do auto finance collections. it is going to take some time and effort on your part but you do not want to be responsible for a loan that you didnt benefit from if your auto was financed. If the dealership is also the finance company, contact the FTC and BBB.
