Default False Certificate of Service

Judge awarded a default judgement against me in a civil suit for failure to appear for $33,454/ $4.48 per diem & $2,000 in fees. Later authorized a bench warrant for failure to appear at the asset hearing. Can prove beyond any doubt, that both affidavits of service filed by the process server were false.

Are there any money damages available.

Default Re: False Certificate of Service

You may be able to set aside the judgment.

but if you don't appear you have no say--so do appear whenever any proceeding is scheduled.
