I haven't been charged with breach of conditions yet
But I'm worried they will ask a drug test when I go to court next time
I'm on tribunale sante mentale (mental health tribunal)
The psychologist in charge of my case reviewed my past charges and doctors reports 2 months ago and didn't ask for a drug test, I had a small relapse but I've been clean for almost 2 months, don't you think she would have tested me 2 months ago
I'm in municipal court in Montreal for the tribunal sante mentale and the suspended sentence I have is in federal court
What will happen if I'm drug tested in municipal court and come back positive
Will it go back to federal court or what?
My lawyer said they won't drug test me but please answer my questions as if he didn't say that, because that's how I'm thinking
In your case, as you have violated the conditions, the Judge can put you in prison/jail or suffer whatever punishment was previously suspended. The judge is the one who will decide the penalty. The biggest factor in all of this is usually what your prior criminal record is. Retain the services of an attorney who can thoroughly examine the facts of your case. He/she would then be in a better position to analyze you case and advice you of your available options.
So you mean that I may do the time I have left on my suspended sentence
Or do the time for the crime I committed
They told us to call legal aide. We did and they told us that they could not help us at the moment because they didnt have enough lawyers until next month. How am I to keep a 3yr warm on these cold nights until next month? He dont even provide any source of heat. My mom had to buy us a heater!
