    If the earnings withholding order is not for spousal or child support, the debtor may file a claim of exemption with the Sheriff in an attempt to terminate the wage garnishment or to reduce the withholding amount. The Sheriff will mail a copy of any claim of exemption and instructions on how to oppose the claim to the creditor. The wages of a spouse not listed as a debtor on the writ of execution may only be garnished pursuant to a court order.
    An Earnings Withholding Order should be used to levy on monies earned by the debtor for personal services rendered (whether called wages, salary, commissions, bonuses, or anything else.)
    The Earnings Withholding Order includes a warning to the employer stating, "It is illegal not to pay amounts withheld for the Earnings Withholding Order to the levying officer.

    For all other enforcement of judgment actions in California, i.e., bank levy, automobile levy, property seizure; use the Claim of Exemption (Enforcement of Judgment), EJ-160 (http://www.courtinfo.ca.gov/forms/fillable/ej160.pdf).

    Your claim of exemption must be filed with the Sheriff within 15 days of the date the levy was mailed to you. If the levy was personally served on you, you have ten days from the date of service to file a claim of exemption with the Sheriff. Submit one original signed claim form and two copies, with or without the financial form and copies.

    A claim of exemption for a levy under a Writ of Attachment must be filed with the court pursuant to CCP §482.100(c).

    If your wages are garnished, you may file a Claim of Exemption (Wage Garnishment), 982.5(5) (http://www.courtinfo.ca.gov/forms/fillable/98255.pdf).

    Your claim of exemption may be filed with the Sheriff at any time during the wage garnishment period. Submit one original signed claim form and two copies, and one original signed financial statement, EJ-165 (http://www.courtinfo.ca.gov/forms/fillable/ej165.pdf), and two copies.

    Hi Admin, thanks for providing this great forum. I am just wondering if you can please delete the following post / thread as I decided that its probably better not to discuss it on the forum http://www.worldlawdirect.com/forum/...tml#post102612 I have however sent a request on your main page but havent got a response from a lawyer, do I need to pay the 9.99 now or do I pay after I get a reply?
