Angry Refused cerclage

My first child was born when I was almost 27 weeks and thank God he is alive and healthy today. My second pregnancy (3 years after my first child) ended in a early miscarriage. My husband and I heard about a cerclage after the miscarriage. So when I found out I was pregnant again, we made sure to tell my OB/GYN that I wanted one BUT the doc kept refusing to give me one. He came up with a bunch of excuses. He knew about my previous pregnancies and still didn't want to give me a cerclage. We thought he knew what he was doing since he was the doc and we trusted him. Plus we were knew to the city. Well, my beautiful baby was born in my 23rd week of pregnancy and after struggling months to live, he passed away. Do I have a case against this OB/GYN? I really appreciate any help!

It is certainly possible you have a case based on what you say here; you should take a brief description of these events as well as your medical records to a malpractice attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis if they think you can win; you would pay only if they collect for you.
