I'll try to explain the situation as briefly as possible. I just want to know if there's anything I can do legally. I went to the doctor last month because I had blisters. The doctor was in the room less than two minutes and did not examine very closely. He quickly said it was chiggers and gave me a prescription for a $35.00 ointment I needed to apply all over that night and again a week later. A couple of weeks later I went back and my condition had gotten worste. This time the doctor actually examined me closely and determined it is actually MRSA.
Overall with the first visit I payed $95 plus the ointment. This may have been avoided along with a lot of unbearable itching due to the blisters, if the doc had taken to time to examine me better the first time. Do I have any recourse or should i chalk this one up to a lesson learned? Thanks in advance for your response. |

You could try to get it back but unless he was outright negligent he can argue he did provide service. The doctors dont always get it right the first visit. You did go back and it was resolved--he may split the bill with you.

The MD wouldn't know it was MRSA without getting a culture. Insurance does not usually cover a culture unless symptoms persist and first line treatment wasn't successful. It does not sound like negligence.
