I had a hernia repair surgery done on July 5, 2007. The surgery seemed
to go okay, but I still have not made a full recovery. My surgeon decided to release me back to work on 8/6/2007. This was after 2 visits to him complaining of increased pain, nausea and fever.I had seen my Doctor prior to my visit with the surgeon and she had found a bacterial infection and yeast infection in my bellybutton (below the incision) and the surgeon wrote both of these things off saying that we all have bacteria on our skin so that\'s not uncommon and yeast tends to grow in dark moist places so he wasn\'t concerned. In my last visit with the surgeon, he yelled at me and told me that the hole in my lining was only as big around as his pinky and he didn\'t understand why I was still in pain and he blamed it on my Fibromyalgia. To appease me he scheduled me for an Ultrasound. They did not find anything on my ultrasound. His nurse called me and told me that there was nothing wrong with me and I could return to work on 8/7. I advised her that I was still unable to drive or wear normal clothes (only stretchy waists) and she told me that all I do is sit at a desk all day so there was no problem with me going back to work. I went back to my Doctor after the surgeon and she sent me for a second opinion. That surgeon sent me to a pain specialist who I went to see today. The problem is the only person who can sign off on my Short Term Disability is the original surgeon who doesn\'t believe that i\'m in pain. What rights do I have as a patient whose pain was disregarded? What rights do I have with Short Term Disability? Please help! |

You could get an injury attorney involved and they may threaten court action to get the evidence seen and the issue resolved.
