Hello, I'm a current undergraduate at a university and was hoping I could get some insight. So I goto the school clinic hoping to get a diagnosis and treatment for this lengthy illness I had. Cough, fever, sweats, chills, fatigue, etc. I get a nose swab and come back negative for influenza so my doctor puts me on antibiotics. I guess he thought I had bronchitis cause that's what the "diagnosis" said later. Anyhow, I take the 10 day course of antibiotics and don't feel any better. In fact, I would say I felt worse. I went back to the clinic but this time I met a nurse practitioner and she ordered some urine and blood work to be done. I get some results immediately and the nurse tells me to goto the ER right away, no questions asked. So I goto the ER, and end up getting admitted with acute renal failure. After a lengthy hospitalization, a biopsy and numerous other tests, the team of doctors believed I had a very severe allergic reaction to the antibiotics prescribed to me by the clinic doctor.
Now the question I have is is there any way or form to receive compensation? I felt the doctor's course of action was very hasty, especially considering when later blood tests revealed that I had a viral infection in my body that probably initiated the whole illness pre-kidney failure. |

Whether or not you have a case that is worth pursuing in court will depend not only upon proof of the doctor's negligence in diagnosis, but also on the measure of damages -- how much you were injured by his failure to meet the standard of care in practice. That will determine whether it will be worth your time and a lawyer's to pursue a malpractice suit.
My recommendation would be to see a personal injury lawyer who does medical malpractice for he or she will be able to best evaluate whether or not you have a claim and, most importantly, whether or not it's worth pursuing. |
