writing controlled substances prescriptions for family members
My husband a surgeon for many years has written prescriptions for controlled substances like xanax, valium, fiorcet, adderall. One kid now has a heart issue. I have coordination issues and fell a couple of times once breaking my foot. I have double and blurry vision daily on and off, focus and memory has become a problem and coordination issues and had a full work up by a neurologist with no pathology found. We live in NYS and am wondering if there are consequences for this. Thanks

I wish to inform you that if your husband has written incorrect medicine then he may be liable for medical malpractice. In this regard as your husband is a doctor and further surgeon therefore it is assumed that he will give correct medicine but if wrong medicine is given then he may be made liable. The lawsuit will be for medical malpractice along with compensation for loss of health. Further expenses on necessary medication required may also be claimed.

The medication he wrote was clearly not in his scope of practice. There is no chart documenting the need for the drug, the effects or to justify the quantity. What are the consequences if he is writing for controlled substances for himself as well?
