I will try to summarize as best as I can. History: My daughter is 15 yrs old and will be 16 in November this year. I have been trying to get her/keep her on birth control since she was 13 (one year after the start of her menstrual cycle). This is NOT because she was in an environment to have sex. It was for several reasons; however, the most important one to me was so that she was used to the pill, didn't forget to take them, dosage was adjusted,
appointments made, etc...like clockwork by the time she was of dating age. I wanted it to be as natural to her as breathing before she started un-chaperoned dating. This was just in case, once she was out there, she made a mistake. She is still chaperoned at this age. I have faced ALOT of flack for this from everyone but my family. I got pregnant with her at the age of 16 and they are firmly behind me in doing everything I can to make sure she doesn't do the same. All that said - I have taught her that sex should be saved for a time when you are older because you are more experienced in life, have a greater respect for it, and have learned what a relationship should be based on through experience and how to be closer to your partner without sexual contact...etc... She focuses on her school work, she is in NJROTC (and just won an award only 10 students out of 245 got), she is an A-B student, she has friends, a boyfriend (2 months younger than she is), she has played soccer, done cheerleading (earlier - we could not afford it in school), etc. - We are involved in her life, know her friends parents, her boyfriends parents, we spend family time and play together etc. She told the people at the health department that she was having headaches and then they would not give her birth control until her Doctor said she was ok and not having reactions to the birth control. We went to the Doctor. This Doctor gave my child a pregnancy test without my knowledge or consent. It came back positive and then borderline. The doctor came in and accused her of having sex and would not accept any answer she gave, called her a liar, and told her that she should not be thinking about sex at 15 or masturbating. She told my daughter that she believed she was a sex addict because she was masturbating. My daughter wound up crying and has been scared by the event. The doctor did a blood test (that one I knew about) saying it would tell the number of weeks. I allowed it and told my daughter it would prove she was not pregnant. I kept telling the Doctor that she was never un-chaperoned, that she had an active life, was doing well in school etc. The blood test came back negative and she has had her period. She is not pregnant. The day the blood test came back DFCS showed up at my door saying that someone lodged a complaint that I allowed her to sleep over at her boyfriend's home (completely unfounded and false), that my children hadn't been to the doctor in 6 years (both had been within a month), etc. My question is, is this legal? Can I compel DFCS to reveal who lodged the complaint? I fully believe it was the Dr or her office personnel under her direction. Can I sue the doctor for her behavior and the fact that my daughter is now afraid to talk about sex, masturbate, or go to a doctor? |

Well....I gotta say...all the wonderful legal advice I got for this situation was overwhelming...the response was so very helpful.....I would like to thank any attorneys who looked at this and said nothing.
I recently found out that this Dr has had 6 other patients file suit against her for this very same thing. |

Well, educating our children about the premarital sex and the other possible ways to have sex during their teens is a good approach to keep the children educated and protected
but some doctors like this might mess up the whole situation i suggest that you must lodge a complaint against such doctors
