What is the name of your state (only U.S. law)? FL
Husband had been feeling ill. Having problems breathing-shortness of breath being main symptom. He was at work in Fl and fainted. They called 911 and he went to ER. He has several other symptoms that he relayed at the ER. One in particular was spitting up excessive fluid and he had never experienced that problem before. (ok, I know...gross) He had a test of the lungs and brain...and was eventually diagnosed with reflux and bronchitis and given reflux meds. He got sicker and sicker over the next couple of days. He had just moved to Florida for a new job and I am still living in Louisiana. He came home so I could help him as he was getting extremely ill. He was in ER on WEd. I took him to internist on Monday where he was diagnosed with cardiomegaly (enlarged heart). He is 43 and in good health. He was sent to cardiologist and diagnosed as being in acute congestive heart failure and hospitalized for four days. Diagnosis is congestive heart failure due to non-ischemic cardiomyopathy-which is weakening of the heart muscle-the cause is usually never determined-frequently thought to be from a virus. Completely unexpected. If you are in the medical field....his ejection fraction was 20% which is severe. So....what do you guys think about the misdiagnosis at the FL hospital. Reflux.....he was in full heart failure....the stuff he was coughing up was "froth" from pulmonary edema. Where did they go wrong with their diagnosis? I think he is lucky to be alive. He was taking all of the reflux meds waiting to get relief. So, just looking for opinion/advice. Thank you!!!! |

It is certainly possible you have a case based on what you say here; you should take a brief description of these events as well as your medical records to a malpractice attorney and see if the attorney thinks you have a claim; often you need to contact several attorneys to find one to take the case; the review of your case and records is often free and then they will normally take the case on a contingency fee basis if they think you can win; you would pay only if they collect for you.
