EEK! unwanted test

while pregnant getting prenatal care at a clinic i signed a form stating i did not want to be tested for hiv. notes were made to my chart about how adamant i was about not being tested. after about a month at a routine visit the doctor told me the results to hiv test. after i asked why was the test taken after i had formally refused it the doctor looked through my chart and saw that the test was refused and simply replied she didn't know why the test was taken anyway. can i sue the clinic for negligence? or sue them at all for performing a test that needed my consent that i clearly refused?

You certainly could for the cost of the test

...as to the mental anguish etc you would need to prove a real and severe mental injury or some other clear damages.
