Exclamation Pharmacist erased refills, not consulting with my DR. Sending me to ER with seizures

Due to my financial situation my Dr. called in a prescription to a pharmacy and one extra to keep on file for the next month. Well a month went by and I got a call from the pharmacy saying, "Your prescription is ready, would you like to pick it up?" So I went in and the pharmacist said she took it UPON HERSELF TO DELETE IT from the computer. I asked why and she said SHE thought I ought to see my Doctor again. He gave me a refill so I didn't have to do that. Anyway my Doctor was out of town and I had been without my Meds for 2 weeks (THIS IS FOR A HEART CONDITION!!!). So last night I had a series of seizures and was rushed by ambulance to the ER. Was what she did legal and is there a lawsuit that I can explore? This is NOT the first time this has happened and it makes my body hurt so much I am bedridden for weeks and become dizzy, confused, weak and last night when I seized so hard I suffered neck and back injuries. Also I am still not able to get my medication, except through the ER and they cut my Meds to .25mg of which I take 2mg 3X a day that I have taken for 5 years. They gave me the equivlent of four days worth!! ANY help would be appreciated!

there is no such thing as pharmacy deleting a refill. if md called in a refill and they have it on file they may not and cannot and will not delete a refill. must be miscommunication. if you indeed had authorized refill and they did not give it to you they deserve a court appearance, you should definitely consider it. this kind of practice must be punished.

I'm pretty sure they have the right to not refill a scipt if it is against their clinical judgement. They can't delete the repeat though since the dr. authorized it - but they don't have to fill it either. They would likely need a good enough reason in case you sued them - but I doubt you'd have much legal grounds.

I wouldnt say that they cant erase something, my son is 2 and on keppra for seizures and our dr. called in a new script which I knew the amount was getting change so I went off the bottle, 5 days later I asked my wife howcome he is getting so much more medicine? She responded it only went up .5ml I said no it didnt I been going off the bottle and it says 2.5 tablespoons, well guess what the pharmacy made the error it was to be 2.5ml not tablespooons thats like 10 times to much, we took to hospital they did there test his liver was up and a few other things were off, and never having a seizure in his life blam started having them! Went back to pharmacy they show the refill as being filled right and even printed us a new label showing it was filled right! But guess what I still have the bottle that shows the error! So where do the error in there computer go? Ya cover it up!
