should she be held accountable for murder?

In a scenerio we are addressing for our ethics class, I am trying to determine if a medical assistant who called in a perscription for a lady for pain killers, who later went into anaphylatic shock and died from them, should be held accountable for involuntary manslaughter or felony murder, since practicing medicine without a license is a felony. Any advice here would be appreciated.
