What Chance Does One Have....

...in trying to hold a nursing home responsible for the death of a loved one?
My family member was in a nursing home *temporarily* while he recovered from a fall and while arrangements were being made for him to be able to live at home...
The nursing home was given clothing and told to keep him dressed warmly because he was thin, and it was winter time, yet they neglected to keep his warm clothes on him and kept putting him in thin cotton gowns that did not cover his chest..He got pneumonia and died 2 days before he was to come home.
This was more than neglect...They went directly against instructions which resulted in his death.
How does anyone prove such a thing?

Pneumonia is caused by bacteria. Even sitting naked for two weeks wouldn't induce a bacterial infection.

What would cause it is not be turned every 3 hrs. which IS negligence.

Also you dont go to sleep and wake up one day with pneumonia, it is preceeded by a suspicous fever and dropping oxygen saturation until it is so low it cause a heart attack.
