Medical Error
Medical error is a preventable adverse effect of care, whether or not it is evident or harmful to the patient. This might include an inaccurate or incomplete diagnosis or treatment of a disease, injury, syndromem behavior, infection, or other ailment.
In the U.S., medical errors are estimated to result in 44,000 to 98,000 unnecessary deaths, in hospital settings, and 1,000,000 excess injuries each year. A conservative average of both the Institute of Medicine and HealthGrades reports indicates that there have been between 400,000-1.2 million error-induced deaths during 1996–2006 in the United States.
Medical errors are associated with inexperienced physicians and nurses, new procedures, extremes of age, complex care and urgent care. Poor communication (whether in one's own language or, as may be the case for medical tourists, another language), improper documentation, illegible handwriting, inadequate nurse-to-patient ratios, and similarly named medications are also known to contribute to the problem. Patient actions may also contribute significantly to medical errors. Falls, for example, are often due to patients' own misjudgements.
Medical Negligence
Any type of medical staff can be held liable for instances of medical negligence. Patients have the legal right to assume the care given to them by medical professionals is at a certain minimal standard and when this has not occurred a medical negligence case may be present. If you or a family member believes treatment received may have been considered medical negligence you are advised to contact a medical negligence lawyer.
Condition Failed to be Diagnosed? Get Compensation!
If you have suffered harm or injury as the result of medical negligence, you may be entitled to receive compensation. Medical malpractice is a bigger problem than most people want to admit.
When doctors, nurses, hospitals, or other health care professionals fail to provide an acceptable level of care, the health care provider may be held liable for any injury or harm suffered by the patient.
Common malpractice cases may include:
- Surgery Malpractice
- Doctor Malpractice
- Hospital Malpractice
- Plastic Surgery Malpractice
- Failure to Diagnose
- Nursing Home Abuse
