Constructive Eviction

The disturbance, by a landlord, of a tenant's possession of premises that the landlord makes uninhabitable and unsuitable for the purposes for which they were leased, causing the tenant to surrender possession.

Constructive eviction occurs when residential rental property is an uninhabitable condition. The uninhabitable condition makes the property unsuitable to live in. When residential real property is uninhabitable, it creates a condition under which the tenant has been constructively evicted; the facts and circumstances are such that the tenant is unable to have full use and possession of the rental property and thus, in reality, has been evicted.

The term is also used to mean the breach of a Covenant of Warranty and Quiet Enjoyment of real property, which prevents a purchaser from obtaining possession of property due to the existence of a paramount claim of title.

live downstairs in this apartment and the person upstairs make jumping or walking hard in ceramic floor, bringing grand kids in weekends and school vacation to running and play like they are in the playground bouncing a ball of basketball all day and till 11 p.m. we call the owner of the apartments some times 3 to 4 times a day leave a message in the phone recorder and never call back to us we talk to the grandmother living upstairs and still the same.
besides of this the grandmother live with is son, and his son look like is sale illegal drugs friends and persons we dont know walk or go inside of the apartment and start to jumping yelling and runningn in the aparment, the police came one time to check.
