Default Asbestos Injuries

Asbestos is a harmful material that was widely used in construction until it was regulated in the early 1980s. Exposure to asbestos has been shown to cause a number of health problems, including mesothelioma, an aggressive and fatal lung disease.

Victims are typically exposed to asbestos at the workplace -- unaware of the serious health risks around them which may one day take their lives (and may even expose their family members to risk if fibers are present and brought home in their work clothing).

Asbestos Injuries

Asbestos injury results from dangerous levels of exposure to asbestos in the work environment or any other environment where asbestos fibers are airborne. Inhaling or ingesting asbestos fibers can lead to a variety of asbestos injuries including cancer and asbestosis. Most types of asbestos injury have a long latency period which means that people who were exposed to asbestos as early as the 1940s are still susceptible to developing a serious asbestos injury.

Asbestos injury is also linked to lung , esophagus, colon, kidney, larynx, and pancreas cancer. The risk of developing lung cancer is seven times greater for people who have been exposed to asbestos.

Symptoms of Mesothelioma

Though chemotherapy, radiation and surgery may be prescribed to treat mesothelioma, this deadly form of cancer is considered incurable. Symptoms are often non-specific (fatigue, coughing, difficulty sleeping), and may be signs of other less serious medical conditions.

Paying people with less serious injuries contrasts sharply with the outcome of court cases over asbestos exposure, in which more than 85% of asbestos damages are paid to those with cancer, according to both plaintiffs’ and defense lawyers.

Others have found what they believe are illegitimate claims. Garlock Sealing Technologies LLC, a New York-based gasket maker, paid almost $10 million in court damages in 2008 to three plaintiffs whose family members died as a result of asbestos injuries. The plaintiffs later tried to recover additional damages from various trusts, according to court filings, which isn’t illegal but which Garlock felt was double-dipping. “We found the plaintiffs were pursuing claims we had already paid,” says Garlock’s attorney Garland Cassada, who alerted the trusts and thus averted any double payments for the same claim.

Typically, people with asbestosis are those who have long term workplace asbestos exposure. Most mesothelioma victims have had long term workplace asbestos exposure where they were developing an asbestos injury unknowingly. There is a long latency for mesothelioma or asbestos to develop as well as asbestos injury.
