Default Demand letter

A demand letter is letter stating a legal claim (usually drafted by a lawyer) which makes a demand for restitution or performance of some obligation, owing to the recipients' alleged breach of contract, or for a legal wrong.

In the United States, demand letters from a debt collector relating to a consumer debt must comply with the Fair Debt Collection Practices Act.

In some cases in Canada, a demand letter is mandatory; without it, a person could lose his or her case.


Demand letters basics

Before going to court, it's wise to send the other party a short, clear letter demanding payment. It may seem too good to be true that a simple letter can result in the other side paying what you ask or agreeing to an acceptable compromise, but demand letters initiate a successful resolution in as many as one third of all potential disputes.


Settling your car insurance claim

You don’t need to be a great writer to draft a demand letter. Setting out the necessary information to support your demand should be sufficient. CAUTION: If you are not confident that you can write the letter, you may want to consult a personal injury attorney.


Demand letter for a small claim

For most people, using the court to settle a dispute is a last resort. For that reason, many courts require you to first request payment from the other party before you can sue. You can make your request personally, by phone or in writing.

One of the best ways to meet this requirement is to send a demand letter via certified mail. The letter should be written in a very clear but non-abusive tone. It should start with the facts of the case and why you feel payment is justified. The letter should also outline exactly what you are seeking and a deadline for payment.

Keep a copy of the letter and the confirmation receipt of delivery, to show the judge you have made your best effort to collect the money without going to court.


30 day demand letter

Massachusetts: 30 day demand letter

If you are unable to resolve a complaint with a merchant informally, then you may decide to take legal action. If your problem involves an unfair or deceptive practice, which is a violation of the Massachusetts Consumer Protection Act, the law requires you to send the merchant a letter 30 days before filing a claim in court. (M.G.L. c. 93A). The letter must outline your complaint, the harm you suffered, and how you want the problem resolved. This is called a 30 Day Demand Letter.

The merchant must make a good faith response within 30 days, or it could subject him/her to triple damages and attorney’s fees. The 30 Day Demand Letter serves to encourage the merchant to negotiate and settle the claims out of court. It also establishes the amount of monetary damages you can recover if the charges are proven in court.
