AUSTRALIAN LAW

Lawyers in Australia practice many different kinds of law, which can be divided into set groups. Firstly, Australian law consists of common law, which is based on the English common law system. Following from this, there are also federal laws enacted by the parliament of Australia and laws enacted by the various state and territory governing bodies.

The most important law in Australia is the Constitution of Australia, which forms the basis of the Australian government. Naturally, some lawyers deal specifically in constitutional law, and though there is no Bill Of Rights in the Australian constitution, the parliamentary system is seen as enough to protects the freedoms and liberties of the Australian people.

Unlike in the United States, Australia has a single binding common law that lawyers around the country practice. Historically, Australian law has been heavily linked to the English legal system, but in recent times there has been notable distinctions between the two.

Other important elements to lawyers and the Australian legal system include customary law and international law that attorneys, lawyers and all those practicing in the legal system must regard and adhere to. Customary law was largely formed in its modern guise thanks to the Mabo decision, which led to forming of the Native Title Act.

International law that affects Australian lawyers include the International Covenant on Civil and Political Rights, the Convention on the Elimination of All Forms of Discrimination Against Women, the Convention on the Elimination of All Forms of Racial Discrimination and the Convention on the Rights of the Child.
