Default ‘Wife Is Dying, Postpone My Trial,’ Says Bid-Rigging Defendant

CDR Financial Products founder David Rubin, a key figure in the government's sweeping muni-bond bid-rigging probe, has asked a federal judge to postpone his upcoming trial because his wife of 26 years has terminal cancer and her "death is imminent."

Rubin’s trial, set to begin in January, is expected to last two months. His lawyer, Bradley Simon of Simon & Partners, requested in a motion filed late Wednesday that the trial be adjourned until 35 days after Gail Rubin’s death, or that Rubin be cut from the indictment, which includes three other defendants, and tried by himself at a later date.

“There is a substantial chance that Mr. Rubin will be on trial in New York during the last months of his terminally ill wife’s life,” Simon wrote. “As a result of this unparalleled distraction, Mr. Rubin will not be physically or mentally capable of meaningfully participating in his own defense.”
