Default After Son Makes Case to Biogen, Fred Baron Gets Tysabri



Fred Baron will get Tysabri after all. Baron, a pioneer of asbestos litigation and big Democratic fundraiser who was recently diagnosed with final stage multiple myeloma, a terminal form of cancer, received the drug after a “legal basis” for its use was found, his son Andrew Baron reportedly wrote in an e-mail to the Associated Press.

Yesterday, Naomi Aoki, a spokeswoman for Biogen, the maker of Tysabri, told the Law Blog that Tysabri was approved for multiple sclerosis in 2004. But then Biogen voluntarily withdrew Tysabri from the market because it had caused a brain infection, known as PML, in three patients.
