eviction due to non payment of rent
My Landlord and I had a written lease agreement made, since that aggrement was made their were some oral modifications that were made. I paid him a year in advance, and I have proof of the money wires . however he is now trying to evicit me for late payments, will my oral agreement over ride the previous written one in court if I can show proof that I paid him?

Oral agreements cannot be proven in court. It always turns into a he said-she said argument. Neither one can prove to the judge what was truly said. Whatever was listed in your written contract is what will be upheld in court. Follow that agreement.

I am renting a place that has issues with water supply. Before i rented it to the renters I have now I explained that to them. I have a written agreement that is not notorized its moreless an agreement on paper. I explained to my tenants that I could not afford to rent them the lot anymore but they still have the option to purchase the mobile home. My question is do I need to abide by the agreement we have on paper that basically is not legal? In the last 6 months I have pulled the well pump and replaced everything with new supplies and still can not figure why they are still having issues with the water. Please give me some advise before I evict them.

Normally yes you do but have legal counsel review it carefully if the issue is critical as there are many ways to void it or find exceptions etc. depending on the facts.

How long is your written agreement for? Is it written as a term lease (written for more than a month) or is it merely a month to month agreement? Is it a sales contract or a rental agreement? If you have a term lease (rental), and it has not expired yet, you cannot end it. If it has expired, you can terminate like the month to month agreement below. If you have a month to month rental, you can give the appropriate amount of notice for your state and terminate the agreement. If it is a sales contract (which it doesn't sound like since you say you can no longer rent them the lot) you should have an attorney review it.
Could the low water be caused by a well that is not deep enough? |
