My boyfriend and I are named on a lease but I am the only signer on it; we are separating due to daily arrguements for the last 3 months. It has not gotten physical but extremely verbal and he breaks things in the house. I want him out ASAP.
I told him he has 30 days to get out as of February 1st and find a new residence for himself and his 2 children (7 & 9). Is a verbal communication okay or do I need it in writing? Are there additional steps I need to take to get him out or can the landlord enforce his removal or do we need to go though a lengthy eviction process? He has not actively looked for another residence and the 30 days are almost up can I still make him leave or do I have to let him stay? What is the easiest and QUICKEST way to get him OUT!!! Thanks |

I have sent you much of this info in a PM. You have 2 options. Contact the LL and find out if he is a liable lease holder or just an authorized resident under the lease. He may just be considered a resident since he never signed to be liable for the lease terms. If he is not on the lease officially, but is just a resident, you or the LL may move to have him vacate. You or the LL may give 30 day written notice to vacate (and keep a copy in a safe place if you give it). You may need it later for the eviction. If he doesn't leave, eviction must be filed.
The other option if the arguments escalate and you fear for your safety is to file a restraining order or a protection order against him. This will force him to move out immediately and have a police escort to retrieve his belongings. But you can only do this if you are in fear. A domestic violence coalition or office can give you more information on this. Do not allow it to escalate to where you are in danger. (Does your LL know of his tendency toward violence and that he is breaking things in the unit? He will be more helpful in removing him, or may ask that both of you move out if he sees damages.) Either way, it would mean getting away from the BF. And don't take him back later! Good luck. |
