Default Evict a roomate

If I decide that I want to "evict" my roommate, what am I legally able to do?

My name is on the lease, his/hers is not, and she/he is strictly renting from me. She/He pays me her/his part of the rent in cash, I then deposit that into a bank account, where my check is cashed, that I have written to the landlord.

We are in a two bedroom apartment. He/She is renting the bedroom.

What laws am I required to follow?

What is your agreement--if it is month to month you can ask them to go at any time and in 30 days they must go or you may evict in court.

It sounds as if you are subletting the BD to another person. What does your lease say about subletting or subleasing? (Are you allowed?) Did this person sign a lease with you or is he a month to month tenant? If a month to month tenant with no agreement, you can give him 30 days written notice to vacate the premises. If he does not leave you will have to evict.

However, if your LL does not know that you are subleasing part of the apartment and does not allow it, you may find yourself in hot water with him!
