What is the law in the state of Missouri regarding giving notice when you are on month-to-month. Does the tenant have to give 30 days notice on the 1st of the month?

Are you asking if your state is a term state (where all notices must be given at the beginning of a rent cycle) or a day for day state (where notices may be given at any time)? If this is your question, I do not know which it is. You would have to look up your state's LL-Tenant laws (MO Revised Statutes 441.005 to 441.880 and 535.150 to 535.300) and look for a section on notices or look under MO Revised Statute 535.060 (the state rent rules) and see what it says on giving notices. It may say something such as "notices take effect at the beginning of the term", in which it is a term state. You would have to give notice before or with your rent.
***If you are asking if you must give 30 days notice, your state law says "one month's notice" on a month to month tenancy (MO Revised Statute 441.060). Check this statute especially, as this is where your answer may be found for either term state status or the notice requirement. |
