I evicted tenant for nonpayment of rent. 6 month lease is the tenant still responsible for paying the back rent and the rent for the until apartment is rerented. Thank-you

The tenant is still responsible for any back rent that they owed you up to the date you received possession of the unit back. So if they owed 2 mos. rent when you filed and another month went by until the court officer removed them, they would owe you for 3 months of rent. If you haven't already done the deposit statement, you can use whatever is left after damages to go towards this amount, then send them a bill for the rest. If they don't pay, you can file in small claims court for a judgement for the rest of the money.
Whether they owe rent after the eviction is up to state law. Here, once I remove them by court ordered eviction, they aren't responsible for the rest of the lease. Read through your state's law or call a local LL association and ask what is allowed there. |
