Thank you for the suggestions, I am sure they will be useful to anyone who reads this post. Even though my contract does not outline all of the things you recommended, I did all of these things for my own benefit, just in case. I am, however, going to amend to include the words sieze possession of the premises and any possessions left in the premises. and without further notice to the tenant

I notice that the state of Idaho has been mentioned, perhaps you may have a recommendation.
My friend was physically abused by her boyfriend. After the first incident, she stated that she would be moving out. He promised to remain civil and stay away from her while she searched for a new place to live. This was near the end of January, she paid him rent on Feb 1st and they agreed that she would be moved out by the end of the month. Days after she paid Feb rent, he beat her again. She left, and when she returned to collect her things found that she was locked out. It has been quite a hassle for her trying to collect her belongings, and shockingly, though she contacted law enforcement to secure her safety they seem to be most concerned with infringing upon HIS rights as the owner of the home where they were residing. I have been unable to locate Idaho laws regarding her property and her right to access it. Insight with regard to the landlord/tenant aspect of this situation would be appreciated. |

To the new poster:
How long has she lived in the unit and does she have proof of rent paid? (Check register, receipt, etc.) If she can show the police that she has paid rent and show proof that she lives at the unit (mail addressed there, driver's license, etc.) she is a tenant at that unit. The police should allow her entry into her unit (even though it is also the BF's house) to retreive her things. She may want to contact a coalition for domestic violence because they will provide her much needed help in getting the police department's cooperation and will get a restraining order for her if needed. Your friend can actually sue her BF for illegal eviction (a LL can't change the locks on a tenant, especially when the rent is paid). |
