My husband and I entered in a 1 year lease for an apartment on 05/Sep/2007
and he recently received military orders for a permanent change of station. I know that a lease can be broken with military orders but my question is there a time limit that this must done it? I am currently attending college full time and I will graduate this May 2008, so I am going to stay behind with my son while my husbands leaves for his new duty staion. Upon graduation I intend to move to where he is stationed. Can I submit the orders in April to break the lease in May 2008 when they were issued in October 2007 or is there a time that this must be executed? Can I submit in writing with a copy of his orders to my landlord now to break my lease in May, or would that not work? I am not trying to screw anyone over so I would like to give them advance notice but I need a place to live with my son while I finish school as well.. |

You might check with your base legal team as well but as far as I understood it had to be dome at the time of deployment of the person leaving.
