Hello everyone, thanks for taking the time to read about my plight and lend
me a helping hand. Me and three of my buddies are renting a house in Felton California. The house is also for sale and we did sign a lease agreement stating we would keep the house in showable order to prospective buyers. My property manager, after having shown the house to one person felt she needed to evict us. The problem is not that the house is messy or in a state of disrepair, actually it is quite clean and orderly. The problem she found was that there was bb guns out and posters with beer logos and that sort of thing. Also, we had some pipes out that she disagreed with. Anyway, i dont feel that beer posters warrant a breach of the lease. What is the legal problems here and what are my options? Thanks again! |

She may not win on that if it goes to court; she has to give you some kind of chance to clear up any problem and the breach has to be material--
Drugs of any kind should not be on the premises of course. |

Posters may be in bad taste, but do not violate any lease agreement unless it states you cannot put anything on the walls. BB guns, unless outlawed or regulated in your area, have no effect on the property or the sale of it. (Although I would put them up when there is a showing to prevent children from handling or possibly getting hurt on them. You may be liable if this happened.)
However, the type of "pipe" you had in the premises may be enough to get you evicted. Some states have laws that state if the LL had reasonable cause to believe that drugs were being used on the premises, you are subject to eviction. My state is one such state. You would have to check the laws in your state to see if there is a similar law. If you or your roommates were using drugs on the property, she may well have cause for eviction. Drug paraphenalia (like "pipes" - unless for tobacco use) are reasonable cause. |
