Unhappy Roommate Rent

Hello, I am from Calgary, AB Canada.
I had a guy move in last month into the spare room in the apartment I am renting. I am the only legal tenant. He paid me $300 for the first month and a $300 security deposit. The rent is $600 a month. I have only seen this guy 3 times since he moved in and I have not gotten any signed agreement. He has yet to pay this months rent and I have not been able to get a hold of him. How can I go about getting my rent money or evicting him. There are items in his room ie. couch, computer, stereo, dvd and other items. What can I do??

Sue him in small claims and/or file for eviction in local court.

I agree with msg. Call the local court and ask if you can begin eviction proceedings if you are not the owner. In some places a tenant may evict a co-tenant for non-payment. If this is possible, the first step would be to post a pay or quit (or other notice) for the non-payment of rent. If you cannot evict him, file suit in small claims court. Since you do not have a signed written agreement with him, I would give him a 30 day notice to vacate the premises for non-payment of rent. This would mean he has to leave within the next month. My other question, does you LL know you are sublettiung out a room in your apartment? Is this allowed under your lease?
