i have a mice infestation in my apartment, i have taken pics of all the dead mice, and the droppings. also i reported it to the health bureau and i gave the landlord a notice about it as well. this was 2 months ago and the problem still exists. can i legally hold rent, until he fixes problem

Did the health department come and inspect your unit? They should. If they have not done so, call them again immediately and request an inspection. They will cite the owner with healths problems (rodents) and will make him fix this problem. You said you gave the LL a notice. In writing? Did you keep a copy? Send him another notice immediately, in writing, mail it certified mail, return receipt requested, and keep a copy for yourself. In it detail that you have notified him previously about the problem, detail what the problem is, and give him a deadline (like 10 days) to contact you to let you know when this problem will be addressed. If he doesn't respond or start measures to take care of this problem, call the clerk of court. Ask them if you can rent withhold (this is not legal in all states) and ask what their procedures are to do so. Follow the procedures to the letter and be sure to deposit the rent on time each month until the problem is fixed.
