That was way too long, but certainly sounds like you enjoy the drama?

Are you now month to month or have you signed a new lease?

If you are month to month, give written notice via certified mail return receipt of your intention to vacate by August 1st. Go find another apartment.

If you are under a lease term you need to stop talking to all these people, and be sure to give notice before the end of the term.

Month to month. We do not want to move. There must be laws here in California to protect us from this.

There are no laws against stupidity or drama.

This situation reeks of both. If you WANT to fix it, move. These people will never change. If you stay you will then just have to live with it.

Protect you from what? From crazy?

There is no law to protect you from crazy.

You are not quite normal for wanting to stay in this situation. It's not going to get any better.

Other people's trash is not your problem. Not bringing in cans in a timely manner--really? Ignore this, or bring them in yourself if it bothers you that much.

San Diego is a big place. When is your lease up?

The obnoxious neighbor is moving. As to the condition of the apartment appliances, heater, etc., you have contacted code compliance and need to follow up until you have heat. Keep your contacts with the landlord to written communications, not phone calls. That way you will be able to document what he knew and when, was asked to do and when. And keep the notes brief and to the point.

There are laws on the books in California about retaliatory eviction for reporting code violations, but that is not applicable.

I concur that moving to a more peaceful place with cooperative landlord seems the best answer. You are month to month and all you have to do is give notice.

We want to move. Money is the issue. The LL Sister has access to all the keys in the building. The next door neighbor has access to all the keys in the building. I assume that these people are the LL's Agents who are harassing us. I have a signed receipt from the next door neighbor for my deposit. When the LL travels the next door neighbor does the LL job for him.
We would like to take this matter to small claims court. The landlord said if i keep calling him he would give me a 30 day notice. This is the 2nd time a verbal notice has been said to me since code came into the photo. We should not be forced to move.

Looks like we've all given you our own best advice.

Yeah, you want to move but money is an issue. I get that.

Oh well.

At this point, it's up to you and your LL and what each of you will do.
