Hello and thanks for taking your time to read this.
I am a student living in the UK and am currently renting out an apartment. The apartment is meant to be occupied by us until the end of June. Since we moved in in September 2011 this would make the contract ten months long. However I have been looking over some of the documents of the tenancy agreement and have been noticing inconsistencies, most of which I plan to settle with the landlady (hopefully tomorrow so a quick answer would be appreciated), but one that I am completely stumped by. The ''Student and Guarantor application for tenancy form'' states that the contract is nine months long (this has been handwritten by the letting agent), but the ''Student Guarantor Agreement form'' states that the contract is ten months long (this has been typed). So which is it? My guess would be the first one being right as that form was the one we signed for the house, whereas the other is just a guarantor form. It's also worth mentioning that the landlady has discontinued using the letting agency and everything we do is through her. A few months ago she came over to tell us that the contract is for ten months not nine like the original contract said. My second question is that if she has failed to update the contract (which is entirely possible) does that mean we are obliged to pay this months rent? If the original contract states nine months surely we only pay nine months. My last question works on the assumption that we only need pay for the original nine months. Obviously we are already into June and it's only now that I am finding this all out. If we are not meant to pay for June, but she has allowed us to stay for a week now, then what can she do if she finds out it's not in the contract? I was planning on leaving soon so I don't mind saving the rent I should have paid in return for leaving early, but the other tenants may not leave soon, and they have paid already. Thanks again and I hope someone can help. |

I wish to inform you that the period of lease can be determine by reading agreement as a whole. In this if your duration from September to June is mentioned then this period of nine months will only e taken into consideration. You can inform landlady about correct facts and can thus restrict your liability. If you are staying in June then the rent for June will have to be paid unless landlady gives you exemption from rent in writing.
