I am currently living in Florida. I have a 3 bedroom/2 bath apartment which is on
the 1st floor on the corner of the building. I moved into these apartments about 5 yrs ago. (1br/1ba at beginning for a year then transferred to a 3br/2ba ) These apts are very old, were built back in the 70's. The property managers are a husband/wife team, which they live off site. I've always paid my rent on time for most of this time until this past January 2012, I lost my job and have been unemployed. I receive unemployment and the dates when I receive it, the 2x a month isn't until after the 5th of the month so it has been late every month since January. I have always paid the late fee regarding this. Since I have been late for the past 5 months, it seems when I request repairs done to my apartment that the property managers seem like I am last on there list of things to get done. This is not right!! Right now I have a hole in the ceiling of my bathroom that water comes in when it rains, my kids bathroom where you turn on the faucet, the tile has caved in, both tubs hold water when taking a shower, my front door doesn't open very well with my key when it rains, the front window doesn't close all the way and can not be open at all, my glass doors that lead to the back of the apartment are filled with woody type things such as snakes, posion oak, poison ivy and when it rains, I can't even get out those doors due to standing water. They have just hired a company to replace the shingles on the roof. Well I guess there is so much wood rot under the shingles, that the company (who already started) withdrew there bid. Well the company had started to take off the old shingles on my building, well they didn't pick up all the roofing tacks that come out when you remove the shingles so now my dog, my child and I have all stepped on these nails that have gone through our shoes to our feet!!!!!! On top of that, there is an area where you go to walk your dog, well there is steps that go down to the grass, I guess the steps have broken and I slipped and fell down and hurt my back. Some of the tenants have told the property managers about these steps earlier last month, only to find that the steps are still not fix. I am the 3rd person to have fallen down! What legally can I do about my situation?? |

I wish to inform you that under Section 83.51 of Florida Landlord Tenant Law landlord has duty to maintain premises. Further you can enforce your rights through a civil action under Section 83.54. You can first give a notice and if repair is not made then you can take further legal action. If yo have suffered any injury then you can claim compensation. Further under Section 83.60 you can take defense that delay is there because there is no repair.
