My mother is completely bedridden and needs 24 hr. care. She allowed a daughter and her husband to move into her home on a temporary basis until they could afford to pay rent somewhere. She has done this many times for them. She has been asking them to move out now as they have been living off her modest SS income and small pension check (husband's retirement, but he has been deceased since 2002) for months as she can not afford to support them. They have never paid any monies to her to help toward expenses. I have POA and she has asked that I do whatever is necessary to remove them from the property and has asked me to take over her financial affairs. Upon doing that I have discovered that they have forged checks and because she couldn't afford to pay for them to live there, she has run up a home equity line to the max in order to meet her bills. She also now has bad credit. I am paying these debts and current bills out of my own money and my wife and I are caring for her daily. They refuse to move, to pay any money, provide any care - they come and go as they please. What are my options here since these are family members? I can't afford to support them and if I could I refuse to as this is a lifestyle for them - that is to live off everyone they can. They both have jobs but spend their money on playing and who knows what else. They have turned her home upside down, the husband has stolen items from the home to pawn, and also brings tons of items into the home that he says he picked up on the side of the street....Right? We suspect they are stolen but have no proof. I am desperate to get them out as this has caused my mother distress that she doesn't need. Thanks for any advise.

If they have forged checks on her account, please turn them into the police. You may also want to call an elder abuse hotline (stealing her meager money is abuse). Have them prosecuted for theft. To get them out of the house, I suggest you seek an attorney who specializes in residential evictions and who does so for a flat fee. (Call around, you will find one.) Have him handle their eviction. They will need to be given a 30 day (60 days in some states) notice to vacate the premises. The attorney will know exactly what steps need to be taken in your state. Good luck.
