I have served a tenant with a 30 day notice, the local sheriff said that I could go ahead an d serve with notice of petition and petition before the 30 days were up I did have the sherrif serve with notice and petition and the judge said that the case was dissmissed because I did not wait the 30 days... Do I have to start over with new 30 day notice or can I just serve the tenant with a noitice of petition and petion again without doing the 30 day notice again

Yes unless the judge will allow otherwise. You should request him to allow you to proceed sooner.

Thank you for your response, but I am unclear whether to serve the notice and petition or the 30 day notice ?
Thank you again |

The judge should let you do the petition now and deem the original doc as notice. But confirm with the judge and/or his clerk if you can.
