Smile Evicted tenents keep comming back.

We have evicted several tenants. Occasionally they come back and hang out on the property. I called the police and told them that I saw an evicted person walking on the property. I mentioned that she was seen with one of our current tenants.

The Police said If their visiting with someone on the property their is nothing they can do. Unless they cause a disturbance.

1. Is there a way to keep evicted tenants off o the property?

Once evicted it is trespass to be on the property. Tell the police that and ask that they be removed.

I discussed this matter with our lawyer, (the one who did the eviction) and he said it is a grey aria. He explained that the law and the constitution are in conflict with on another in this case. He mentioned that people have a right to congregation or “get together”. He said that the police are taught this and that is why they did not respond.

My lawyer said that we could try to go after the people who invite or bring the evicted people onto the property.

Next time I call the police I will only mention that I saw the person. I will not mention whom I saw them with.

It seems crazy to me. As I see it if an evicted person wanted to go onto a property he/she could just follow anybody onto the property and say I’m with that guy. Or he could just walk through and round the property all day and tell the police that he is looking for a friend who lives here but he doesn’t remember exactly which unit his friend lives in.

Next time I call the police I will only mention that I saw the person. I will not mention whom I saw them with.

I have run into this problem myself. I got the same answer as you, that laws and constitutional rights conflict. The law says he is trespasing if he returns once he is evicted. However, consitutional rights allow your tenants to associate with whom they like. As long as one of your current tenants has allowed them on the property as their invitee, you usually cannot do anything. The best solution I have come up with is to warn the current tenant that I do not want this person on the property. If they continue to invite them, I refuse to renew their agreement and get rid of the tenant as soon as possible. Once their friend is gone, the evicted one usually doesn't come back again.
