tenant will not move out and has not paid rent for several months

I purchased an existing duplex from someone where there were existing tenants. A tenant on one side of the duplex has not paid her rent for several months. A dispossesory has been filed with the magistrate court but the tenant countered and now the case has to go to state court. The tenant claims to be waiting for her disability income to start as the reason for not paying. What can I do to get this tenant out?

Get a copy of the tenant's answer. What reason does she use for not paying rent? (I doubt waiting for her payments to start will be good enough in court if that is her only reason for not paying.) Plan a response to any reasons she has given for non-payment. Organize all your paperwork on this tenant - payment record (or should I say nonpayment record?), copy of her lease or agreement, any correspondence you sent her about not paying, etc. Then show up in court with all your evidence and present your case. Since it has been sent to the next court, you will have to be patient until that court date.
