EEK! Pennsylvania (PA) Notice to Vacate Requirements

We moved to Pa from Arizona in 2009 as a result of employment opportunity. With our current landlord we signed a 6 month lease form Dec 15/09 to Jun 15/10 afterwhich time it would become a month to month agreement. We have now given our landlord 30 days notice of our intent to move. As we were on a month to month lease and the fact that there was no clause stating notice to vacate requirements we felt that we were doing what was required by giving 30 days notice. His response has been that according to the HOLDOVER BY LESSEE clause he requires us to provide him with 90 days notice and is stating that we will still owe him 2 months rent (3000.00) should we vacate with the 30 days notice given. I did not believe that the holdover clause was related to standard notice to vacate...... We are now within one week of vacating.....who is right here and what should our next step be??

I wish to inform you that 30 days notice is sufficient. You may inform your landlord that your lease ends at the end of each month because it is month to month lease therefore 30 days notice is sufficient in month to month lease. Further 90 days notice is for periodic lease not month to month. You must give your forwarding address to your landlord so that you can receive your security deposit.

LL has no right to claim for 90dyas notice. For month to month lease 30 days notice is enough, which you have already served with. So at the expiry of the notice period you can move out. It seems that the LL is not aware about the notice period for a month to month lease. You may have a mediation talk with him and settle the matter amicably.

Holdover means if you give notice and the landlord finds a new tenant, and then you decide to change your mind and stay.

Your landlord seems not to understand the definition. Either that or he's yet another shark of a landlord looking for money he doesn't deserve.

Inform him that you've given proper notice and if he has a problem with that, you will be happy to see him in court.
