I have been renting a house in Indiana now for 6 months and never before run into a problem like this. My landlord is just rude! I have just renewed for another six months due to the fact that it would be just impossible to move right now. My landlord has lured me in with paying the electric the first six months, and now after the 6 month lease they want me to pay for it, which is fine. Although, I still have no screens in my windows, nor sliding doors. My driveway is always tore up after heavy rain due to not having proper drainage system. Plus they show up whenever they want without calling, some weeks 2-4 times a week. On top of that, they are using my garage as a storage unit. The first lease term I decided to work with them, but now that I have to absorb all the cost, I don't think they should be using my property for their storage usage. Is any of this legal? What should I do? I'm really getting fed up with landlord showing up whenever they want, most of the time it's in a bad part of the day when I am busy. I have been late with rent twice by 2 days, instead of being due on the 1st I handed it in on the 3rd. Yet they get their money every month.

I wish to inform you that you can file a complaint with HUD regarding your landlords behavior. Your lease agreement will determine your termination rights. If lease agreement has mentioned any termination clause then lease may be terminated in that manner. If agreement is silent and in case you intend to terminate lease then this can be done if you can show that landlord has violated terms of your lease agreement as then you are not liable to pay any amount as compensation for loss. If you terminate lease without fault of landlord then you may be liable to pay for loss of landlord for breach of agreement. You can refuse to allow your property to be used by landlord. If you have been late then landlord can object but as he has accepted late payment without any objection therefore now he may not object.

Well here's the thing, I don't want to terminate lease right now because I really have nowhere to go. Although I really don't think they should be coming over 2-3 times a week. I also want my screens in the windows. I was thinking that maybe I should call the police when they keep just coming over or something? With my windows, I dunno I was going to pay for them and take it out of the rent. It just gets really hot upstairs without the windows being open. I tried to discuss this matter yesterday but they didn't feel like talking to me and left. I just don't like to be bothered, and this has never happened to me before. Usually I only see my landlord to give them the rent and if there are any problems but this is violating my peaceful living conditions. I love the location and my neighbor but the landlord is the only problems.

They have to give you a 24 hr notice to come into the property. Also, if they are using the storage area and it's suppossed to be yours by the lease, you should be able to do something about that. I'd call a lawyer and find out what your legal rights are in your stage.
Plus, there is no law against not answering your door if you don't want to deal with them.

The longer you avoid confronting him, the worse you are going to feel and the more depressed and anxious you're going to get.
Confront your landlord and inform him that you will not tolerate him showing up without 24 hour notice during reasonable hours (except emergencies) and that the garage will not be paid for anymore if you cannot use it as was stated in your lease. Back up your words with "I've consulted with an attorney and my expectations are entirely legal and reasonable. Any further problems will result in legal action.". |
