Landlord has not paid HOA fees in 3 years

My Landlord has not paid Hoa fees in 3 yrs and now the Hoa is knocking on my door looking for him. They told us if he does not pay they will take the house and we would have to move. Our landlord has not contacted us when we told him of this and we are worried can we hold the rent to put in escrow to cover us while he lives in Africa and does nothing to help us. There are many thing he has not done around the house to fix either we need advice on what to do. We are on a month to month and I just want to have some peace of mind for me and my family.

Generally HOA fees to be paid by the Landlord. You may please check out your lease agreement (if any) to clarify whether there is any mention as to payment of HOA. You can send a registered notice mentioning all these facts to your LL and ask him to pay off the HOA and do the necessary repairs forthwith (keep a copy of the same). If your LL is not giving a proper response within a reasonable time, then you can hold the rent to put in escrow. It is better advised that you may consult with a Property Attorney who can give a Proper guidance in this regard.
