Confused Pool / Pool Fencing in rented house

I am renting a home in Ontario with an in-ground pool in the back yard. The pool is fenced in, but is not compliant with the most recent City pool fencing by-law stipulations. There is a clause in the by-law that states pools built before 1992 are exempt as long as they met the by-law regulations at the time the pool was constructed. This pool falls under that category. But as a rental, does the landlord have the legal responsibility to bring the pool into compliance with the current Pool Fencing By-laws.

Also another point of contention is that the pool is loosing water - not a drastic amount, but greater than 4 inches of water a week. It has been losing water since the day we moved in. Am I correct in saying that repair of the pool is solely the responsibility of the Landlord? We have not damaged the pool in any way, this is an existing problem.

Any input would be greatly appreciated!

Call the city attorney to see if the LL must now bring it up to code.

You normally are NOT responsible for repair of the pool.
