I moved into a building with 5 apartments in it. At the time there was my apartment and my neighbors who are ok and took up 1 apartment, leaving 3 left. Over the past few months my landlord has allowed alcoholic meth addicted people to move in. these people have been bringing friends over and causing criminal mischief - breaking windows in cars, busted up my motorcycle, and plenty of domestic disputes. The police have been to thier apartments well over 6 times... two of which I called them and got a police citation. So Can I legally break my lease out of concern that these people will continually cause trouble for me because of the friends they are associated with because the landlord chooses to keep these people?

I wish to inform you that your landlord can only be held liable if he was a party to illegal act. He may give the premises to anyone. You may file a complaint against landlord if you can show that your landlord himself is involved in the wrong act.

You can certainly make a formal complaint in writing about the issues, and perhaps demand that the LL make a better effort to maintain peaceful existence there. You are, after all, entitled to quiet enjoyment of your rented premises. If, over an extended period of time, you can prove that the LL fails to exercise control over the actions of his tenants that might interfere with that, you MIGHT be able to get out of the lease. You would have to read over the lease to see what it says on the matter. |
