I moved into a new apartment in California and I thought it was great... Then I found the darker side to this place. First the microwave was found to be unusable due to holes in the radiation screen and melted internal components. Then the dishwasher was found to be missing a piece and had something with the consistency of limestone stuck in the sprayer arms and filters. The bathroom fan upstairs began to literally shake the house as I pondered these things on the 'throne'. The screens are missing downstairs and in the second bedroom I realized a day later. The landlord insisted they never existed but I found some discarded beat up screens in the garage from the previous tenant! My neighbor told me they were in the windows prior to my occupying the place. Another day later and I inspected my security screen door, the metal kind with locks, and realized I had no keys to it! No keys to my own dang doors! The landlord told me we had a security system, but we do not! Now the garage door is broken! The landlord, "Mr.Fixit", spent three hours messing with it before deciding he needed to order a part! And just today, my stove and oven short circuited! I pulled it out and found rat poop! RAT POOP EVERYWHERE! IN THE STOVE, BEHIND THE STOVE, EVIDENCE OF A SMALL FIRE AND NOW I CAN'T COOK ANYTHING TO EAT!!!! The landlord won't return my calls now and I want to know if anyone has any advice! I'm begging you for any help! Whether there be an agency, a plan of action, a law, law enforcement, I need help! First of all let me remind you that as a tenant you have got some basic legal rights. Your LL is duty bound to provide you with a building which is habitable in condition. From the facts it could understand that your LL is not cared to cure the defects you have complained about. As a LL he is duty bound to rectify the defects which you have complained about. You send a registered letter pointing out all the defects and ask him to rectify it within a reasonable time and make the apartment in a habitable condition (don’t forget to keep a copy of the letter with you). If the LL is not taking any action within a reasonable time then you can very well repudiate the contract by giving prior notice or you can with hold the rent till the defects get cured. But remember you should have no knowledge about all these defects before taking the apartment for lease. It is better advised that you may consult with a Contract Attorney who can give a proper guidance in this regard.
