Can the HOA evict my same-sex partner?
I own a condo in Atlanta, GA and live in Savannah, GA for my job. My same-sex domestic partner lives in the condo in Atlanta. He holds a Limited Power of Attorney for my condo so he can maintain, manage, and even advertise/show my condo for selling purposes. On June 14th, the HOA sent us a violation letter stating that they will evict my partner because we do not hold Leasing Status on the unit, and they have accused me of renting/leasing to my partner. He doesn't pay rent to live there, instead it's like a spouse/child/relative living in a condo that one owns. Can a Limited Power of Attorney save us from him having to move out? What else can prove that he is not a "Tenant"? I have let the HOA know that my partner has permission to enter the condo without me present. I haven't told them yet that he holds a Limited Power of Attorney for the property.
What advice can you provide? |

If he is not renting you may inform them, and the court if need be, and they should lose on that charge.
